It is increasingly important to understand and navigate challenging trade-offs between curbing problematic content and protecting independent journalism and fundamental human rights. Efforts to stem misinformation&nbsp;must ensure that governments cannot determine the news that the public receives or serve as arbitrators of truth or intent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Legislation should articulate high-level goals, understand that initiatives in one country or online context inherently impacts other contexts and delegate enforcement to independent bodies with clear structures for transparency and accountability.<\/p>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:32px\" aria-hidden=\"true\"><\/div>\n<\/div>\n\n\n\n<div id=\"issue\" class=\"wp-block-group is-layout-flow wp-block-group-is-layout-flow\">\n<h2 class=\"wp-block-heading has-aktiv-grotesk-condensed-font-family has-delta-font-size\">The Issue<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The spread of false and misleading information is not a&nbsp;<a href=\"https:\/\/www.icfj.org\/sites\/default\/files\/2018-07\/A%20Short%20Guide%20to%20History%20of%20Fake%20News%20and%20Disinformation_ICFJ%20Final.pdf\">new<\/a>&nbsp;<a href=\"https:\/\/www.bbc.co.uk\/bitesize\/articles\/zwcgn9q\">problem<\/a>&nbsp;and appears in many forms: online and&nbsp;<a href=\"https:\/\/misinforeview.hks.harvard.edu\/article\/research-note-understanding-offline-covid-19-conspiracy-theories-a-content-analysis-of-the-light-truthpaper\/\">offline<\/a>, through public and private channels and across a variety of mediums. In a world with growing digital media platforms (where false and misleading information is rapidly spread and, at times,&nbsp;<a href=\"https:\/\/www.theatlantic.com\/ideas\/archive\/2022\/04\/maria-ressa-disinformation-manipulation\/629483\/\">amplified<\/a>), new technologies for digital&nbsp;<a href=\"https:\/\/www.brookings.edu\/research\/how-to-deal-with-ai-enabled-disinformation\/\">manipulation<\/a>, political upheavals in the&nbsp;<a href=\"https:\/\/journals.sagepub.com\/doi\/full\/10.1177\/0267323118760317\">Global North<\/a>, coordinated&nbsp;<a href=\"https:\/\/misinforeview.hks.harvard.edu\/article\/explaining-beliefs-in-electoral-misinformation-in-the-2022-brazilian-election-the-role-of-ideology-political-trust-social-media-and-messaging-apps\/\">election<\/a>&nbsp;<a href=\"https:\/\/apnews.com\/article\/jair-bolsonaro-caribbean-social-media-brazil-b75e51f515b0a708800198afa1b8601d\">disinformation<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.eip.org\/publication\/political-and-media-analysis-on-the-tigray-conflict-in-ethiopia\/\">hostile<\/a>&nbsp;<a href=\"https:\/\/www.nytimes.com\/2018\/10\/15\/technology\/myanmar-facebook-genocide.html\">propaganda<\/a>&nbsp;<a href=\"https:\/\/issafrica.org\/iss-today\/just-who-is-stirring-up-disinformation-in-africa\">campaigns<\/a>, problematic&nbsp;<a href=\"https:\/\/royalsocietypublishing.org\/doi\/full\/10.1098\/rsos.201199\">COVID-19<\/a>&nbsp;<a href=\"https:\/\/reutersinstitute.politics.ox.ac.uk\/types-sources-and-claims-covid-19-misinformation\">information,<\/a>&nbsp;rampant&nbsp;<a href=\"https:\/\/www.un.org\/en\/climatechange\/rampant-disinformation-delaying-climate-action\">denial<\/a>&nbsp;of&nbsp;<a href=\"https:\/\/climate.nasa.gov\/scientific-consensus\/\">climate science<\/a>&nbsp;and declining trust in&nbsp;<a href=\"https:\/\/www.un.org\/development\/desa\/dpad\/publication\/un-desa-policy-brief-108-trust-in-public-institutions-trends-and-implications-for-economic-security\/\" target=\"_blank\" rel=\"noreferrer noopener\">institutions<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/reutersinstitute.politics.ox.ac.uk\/digital-news-report\/2022\/dnr-executive-summary\">news<\/a>,<strong>&nbsp;the credibility of information the public gets&nbsp;<em>online<\/em>&nbsp;has become a global concern.&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Of particular importance, and the focus of this primer, is the impact of&nbsp;<a href=\"https:\/\/www.apa.org\/topics\/journalism-facts\/misinformation-disinformation\">disinformation<\/a>&nbsp;\u2013&nbsp;<a href=\"https:\/\/www.unhcr.org\/innovation\/wp-content\/uploads\/2022\/02\/Factsheet-4.pdf\">false<\/a>information created or spread with the intention to deceive or harm \u2013 on electoral processes, political violence and information systems around the world.<\/p>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:16px\" aria-hidden=\"true\"><\/div>\n\n\n\n<blockquote class=\"wp-block-quote is-style-alternative is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"has-echo-font-size wp-block-paragraph\">Disinformation is distinct from but often used interchangeably with terms like misinformation (which is also false, but may be benign and can be spread without the intention of harm) or malinformation (which is also intentionally harmful, but is not necessarily false). With this in mind, CNTI chooses to use the term disinformation given its (1) falsity and (2) malicious intent. This primer addresses the opportunities and challenges that come with legislative policy responses to disinformation.<\/p>\n<\/blockquote>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:16px\" aria-hidden=\"true\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">The level and impact of disinformation campaigns around the world have a wide range. Disinformation may come from people doctoring&nbsp;<a href=\"https:\/\/www.reuters.com\/article\/factcheck-vogue-hitler-braun-idUSL1N2ZL1OR\">photos<\/a>&nbsp;and creating&nbsp;<a href=\"https:\/\/www.technologyreview.com\/2019\/10\/24\/132228\/political-war-memes-disinformation\/\">memes<\/a>&nbsp;that go viral,&nbsp;<a href=\"https:\/\/www.theguardian.com\/world\/2023\/feb\/16\/team-jorge-and-cambridge-analytica-meddled-in-nigeria-election-emails-reveal\">transnational<\/a>&nbsp;<a href=\"https:\/\/www.politico.eu\/article\/eu-to-launch-platform-to-fight-russian-chinese-disinformation\/\">actors<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/disinfo.africa\/early-detection-and-countering-hate-speech-during-the-2022-kenyan-elections-e0f183b7bdd1\">trolls<\/a>&nbsp;seeking to sow distrust and&nbsp;<a href=\"https:\/\/www.oecd.org\/ukraine-hub\/policy-responses\/disinformation-and-russia-s-war-of-aggression-against-ukraine-37186bde\/\">confusion<\/a>, and elected&nbsp;<a href=\"https:\/\/www.cambridge.org\/core\/journals\/perspectives-on-politics\/article\/donald-trump-and-the-lie\/A438DF5A45FE78CB2BC887859EFAB587\">officials<\/a>&nbsp;attempting to&nbsp;<a href=\"https:\/\/www.pewresearch.org\/fact-tank\/2019\/03\/25\/indian-elections-nearing-amid-frustration-with-politics-concerns-about-misinformation\/\">win<\/a>&nbsp;<a href=\"https:\/\/www.buzzfeednews.com\/article\/daveyalba\/facebook-philippines-dutertes-drug-war\">elections<\/a>,&nbsp;<a href=\"https:\/\/academic.oup.com\/book\/39418\/chapter-abstract\/339133817?\">maintain<\/a>&nbsp;<a href=\"https:\/\/www.niemanlab.org\/2018\/01\/digging-for-dung-unearthing-corruption-this-south-african-investigative-nonprofit-could-help-take-down-the-president\/\">power<\/a>&nbsp;or incite&nbsp;<a href=\"https:\/\/thediplomat.com\/2019\/05\/manufacturing-islamophobia-on-whatsapp-in-india\">hatred<\/a>.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Governments around the world are taking action to curb disinformation: some with the goal of supporting an&nbsp;<a href=\"https:\/\/www.pbs.org\/wgbh\/frontline\/article\/germanys-laws-antisemitic-hate-speech-nazi-propaganda-holocaust-denial\/\">informed citizenry<\/a>&nbsp;and others with the goal of&nbsp;<a href=\"https:\/\/www.nytimes.com\/2022\/10\/14\/world\/europe\/turkey-jail-fake-news.html\">undermining it<\/a>. Actions taken by one entity can impact other countries when groups in one country learn from and&nbsp;<a href=\"https:\/\/www.eff.org\/deeplinks\/2020\/07\/turkeys-new-internet-law-worst-version-germanys-netzdg-yet\">model<\/a>&nbsp;successful efforts elsewhere. Digital&nbsp;<a href=\"https:\/\/academiccommons.columbia.edu\/doi\/10.7916\/D85B1JG9\">platforms<\/a>&nbsp;and interest groups have also put in place&nbsp;<a href=\"https:\/\/www.axios.com\/2023\/06\/02\/us-election-fraud-youtube-policy\">content<\/a>&nbsp;<a href=\"https:\/\/knightfoundation.org\/articles\/what-types-of-misinformation-do-social-media-companies-restrict-its-complicated\/\">moderation<\/a>&nbsp;processes to stem disinformation (though some platforms have begun to&nbsp;<a href=\"https:\/\/www.poynter.org\/fact-checking\/2023\/how-meta-tiktok-twitter-and-youtube-plan-to-address-2024-election-misinformation\/\">move<\/a>&nbsp;<a href=\"https:\/\/blog.youtube\/inside-youtube\/us-election-misinformation-update-2023\/\">away<\/a>&nbsp;from these efforts), but these can vary by&nbsp;<a href=\"https:\/\/www.nbcnews.com\/news\/latino\/climate-disinformation-spanish-misinformation-spreads-impacts-latinos-rcna98823\">language<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/techpolicy.press\/diasporas-disinformation-disenfranchisement-addressing-non-english-election-disinformation\/\">context<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Among the many well-intended legislative proposals to address disinformation, one overarching concern is that the vagueness of what constitutes disinformation (especially the difficulty of interpreting actors\u2019&nbsp;<em>intent<\/em>) can result in policy that controls the press and limits free expression. Even legislation aimed at supporting an informed citizenry can potentially lead to restrictions on both the news media and the&nbsp;<a href=\"https:\/\/www.politico.eu\/article\/germany-hate-speech-internet-netzdg-controversial-legislation\/\">general public<\/a>&nbsp;within a country. Further, policies that target disinformation can easily serve as models for&nbsp;<a href=\"https:\/\/foreignpolicy.com\/2018\/09\/06\/chinas-lessons-for-fighting-fake-news\/\">authoritarian regimes<\/a>&nbsp;or&nbsp;<a href=\"https:\/\/muse.jhu.edu\/article\/607612\">antidemocratic actors<\/a>&nbsp;to exploit. In these cases, the actual \u2013 and, at times,&nbsp;<em>intended<\/em>&nbsp;\u2013 effects are restriction of&nbsp;<a href=\"https:\/\/www.poynter.org\/commentary\/2023\/misinformation-laws-west-africa-benin-ghana\/\">media<\/a>&nbsp;<a href=\"https:\/\/www.aljazeera.com\/news\/2023\/3\/29\/bangladesh-journalist-arrested-after-report-on-high-food-prices?utm_source=Pew+Research+Center&amp;utm_campaign=c2584778e7-EMAIL_CAMPAIGN_2023_03_30_01_49&amp;utm_medium=email&amp;utm_term=0_-c2584778e7-%5BLIST_EMAIL_ID%5D\">freedom<\/a>, censorship of opposing voices and control of free expression.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Thus, it is critical to balance the opportunities and risks of policy responses to the challenge of disinformation.<\/p>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:32px\" aria-hidden=\"true\"><\/div>\n<\/div>\n\n\n\n<div id=\"complex\" class=\"wp-block-group is-layout-flow wp-block-group-is-layout-flow\">\n<h2 class=\"wp-block-heading has-aktiv-grotesk-condensed-font-family has-delta-font-size\">What Makes It Complex<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>A core challenge in addressing&nbsp;disinformation&nbsp;with policy is a lack of&nbsp;agreement&nbsp;on the&nbsp;definition&nbsp;of disinformation and what kinds of content constitute it:<\/strong> The term itself is often&nbsp;interchanged&nbsp;with similarly opaque concepts such as&nbsp;misinformation,&nbsp;malinformation,&nbsp;information disorder&nbsp;and the particularly&nbsp;contested&nbsp;term&nbsp;\u201cfake news.\u201dDetermining which content fits within each category is subject to&nbsp;disagreement&nbsp;and is often politicized. To the&nbsp;public, these terms are used to encompass anything from poor or sensationalized journalism and fabricated content to political propaganda and hyper-partisan content. As challenging as it may be, it is important to strive for a clear and consistent understanding of what disinformation&nbsp;is. Without such agreement, developing effective measures to support an informed citizenry and safeguard an independent press has the added challenge of needing to withstand differences among these labels.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Addressing disinformation is critical, but some regulative approaches can put press freedom and human rights at great risk: <\/strong>Governments\u2019 involvement in decisions around content can allow them to serve as the arbiters of what content appears online, with potentially dangerous consequences for an independent press and free expression. Legislation may intentionally target specific&nbsp;<a href=\"https:\/\/rsf.org\/en\/story-how-press-freedom-was-crushed-six-months-myanmar\">groups<\/a>, including journalists, political opponents and activists, and it may include loopholes that allow for suppression or censorship. Legislation intended to support an informed public may also unintentionally stem speech protected under the basic human right to express ideas. Further, legislation that is effective in one context may introduce different risks in another. Prohibiting acts of expression, particularly using vague or undefined terms, can infringe upon international&nbsp;<a href=\"https:\/\/www.ohchr.org\/en\/special-procedures\/sr-freedom-of-opinion-and-expression\/international-standards\">human rights<\/a>&nbsp;laws. If measures against disinformation are selectively or unequally enforced \u2014 whether by police, regulatory bodies or technology companies \u2014 they can be used as a tool for crushing political dissent, impinging upon freedom of opinion and paving the way for&nbsp;<a href=\"https:\/\/rchdt.uchile.cl\/index.php\/RCHDT\/article\/view\/54436\">illegal surveillance<\/a>&nbsp;or self-censorship.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Adopting&nbsp;<a href=\"https:\/\/slate.com\/technology\/2019\/01\/venezuela-internet-shutdown-censorship-filtering-protests.html\">measures<\/a>&nbsp;such as blocks or bans to combat disinformation can allow state actors to exercise undue control over the flow of information and can isolate users from an open, global&nbsp;<a href=\"https:\/\/cnti.org\/article\/protecting-open-internet\/\" target=\"_blank\" rel=\"noreferrer noopener\">internet<\/a>: <\/strong>Governments\u2019 involvement in decisions around content can allow them to serve as the arbiters of what content appears online, with potentially dangerous consequences for an independent press For example, when state actors apply blocks and bans to journalists they may harm both the freedom of the press and citizens\u2019 basic right to access and share ideas and information, both of which impact people\u2019s participation in public and political life.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>It may not be possible to develop disinformation interventions that suit all digital contexts:<\/strong> The various forms, contexts and audiences in the online space introduce different (and unequal) harms and risks. For instance, users of encrypted&nbsp;<a href=\"https:\/\/mediaengagement.org\/wp-content\/uploads\/2022\/08\/Polarized-Information-Ecosystems-and-Encrypted-Messaging-Apps-Insights-into-Egypt-Ethiopia-and-Libya-1.pdf\">messaging apps<\/a>&nbsp;such as WhatsApp or Telegram in India, Brazil and elsewhere have differing rights to and expectations of privacy and reach than users of&nbsp;<a href=\"https:\/\/knightfoundation.org\/features\/misinfo\/\">Twitter<\/a>&nbsp;or Reddit. Even within the same platform, structured spaces can vary from public to private.&nbsp;<a href=\"https:\/\/www.ohchr.org\/sites\/default\/files\/Documents\/Issues\/Expression\/disinformation\/3-Academics\/Center-for-Media-Engagement-University-of-Texas.pdf\">Dismantling<\/a>&nbsp;encrypted spaces, in particular, does little to combat disinformation and discourages free expression. Another major challenge is in determining which platforms and which countries fall under the parameters of a piece of legislation. This is further complicated by the fact that U.S.-based technology companies\u2019 levels of cultural expertise and engagement lessen the further they get from the U.S., which means the effectiveness of efforts to combat disinformation vary. Finally, disjointed efforts to combat online disinformation risk contributing to a&nbsp;<a href=\"https:\/\/www.europarl.europa.eu\/RegData\/etudes\/STUD\/2022\/729530\/EPRS_STU(2022)729530_EN.pdf\">fragmented<\/a>&nbsp;<a href=\"https:\/\/carnegieendowment.org\/2022\/03\/03\/russia-s-war-in-ukraine-is-watershed-moment-for-internet-platforms-pub-86569\" target=\"_blank\" rel=\"noreferrer noopener\">internet<\/a>, in which people\u2019s online experiences vary by country or region. We address this issue in a separate&nbsp;<a href=\"https:\/\/cnti.org\/protecting-open-internet\/\">issue primer<\/a>.<\/p>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:32px\" aria-hidden=\"true\"><\/div>\n<\/div>\n\n\n\n<div id=\"research\" class=\"wp-block-group is-layout-flow wp-block-group-is-layout-flow\">\n<h2 class=\"wp-block-heading has-aktiv-grotesk-condensed-font-family has-delta-font-size\">State of Research<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In recent years, as governments, platforms and funders turned their attention and investments toward&nbsp;<a href=\"https:\/\/www.tandfonline.com\/doi\/abs\/10.1080\/21670811.2020.1765401\">policy<\/a>&nbsp;and technical solutions to address mis- and disinformation (though this has started to&nbsp;<a href=\"http:\/\/nytimes.com\/2023\/02\/14\/technology\/disinformation-moderation-social-media.html\">wane<\/a>), academic and media attention to the topic has dramatically increased. The research to date has produced helpful&nbsp;<a href=\"https:\/\/journals.sagepub.com\/doi\/10.1177\/20563051221150412\">insights<\/a>, including putting the&nbsp;<a href=\"https:\/\/reutersinstitute.politics.ox.ac.uk\/sites\/default\/files\/2018-02\/Measuring%20the%20reach%20of%20fake%20news%20and%20online%20distribution%20in%20Europe%20CORRECT%20FLAG.pdf\">scope<\/a>&nbsp;of mis- and disinformation&nbsp;<a href=\"https:\/\/www.science.org\/doi\/10.1126\/sciadv.aay3539\">in<\/a>&nbsp;<a href=\"https:\/\/www.nature.com\/articles\/s41562-020-0833-x\">context<\/a>&nbsp;with other online content. The research field also has several&nbsp;<a href=\"https:\/\/misinforeview.hks.harvard.edu\/article\/mis-and-disinformation-studies-are-too-big-to-fail-six-suggestions-for-the-fields-future\/\">shortcomings<\/a>&nbsp;that reveal the need for a deeper and more global approach:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Many studies of&nbsp;<a href=\"https:\/\/psyarxiv.com\/sm3vk\">mechanisms<\/a>&nbsp;to stem mis- and disinformation, such as&nbsp;<a href=\"https:\/\/www.niemanlab.org\/2023\/06\/when-it-comes-to-misinformation-partisanship-overpowers-fact-checking-over-and-over-again\/\">fact<\/a>\u2013<a href=\"https:\/\/www.pnas.org\/doi\/10.1073\/pnas.2104235118\">checking<\/a>&nbsp;(which has&nbsp;<a href=\"https:\/\/reporterslab.org\/misinformation-spreads-but-fact-checking-has-leveled-off\/\">leveled off<\/a>),&nbsp;<a href=\"https:\/\/onlinelibrary.wiley.com\/doi\/abs\/10.1111\/jcom.12166\">corrections<\/a>, and&nbsp;<a href=\"https:\/\/www.pnas.org\/doi\/full\/10.1073\/pnas.1920498117\">media literacy<\/a>&nbsp;initiatives, are robust in their methods but may be&nbsp;<a href=\"https:\/\/www.nature.com\/articles\/s41562-022-01388-6\">too<\/a><a href=\"https:\/\/www.lawfaremedia.org\/article\/there-is-no-getting-ahead-of-disinformation-without-moving-past-it\">piecemeal<\/a>&nbsp;or too&nbsp;<a href=\"https:\/\/www.tandfonline.com\/doi\/full\/10.1080\/10584609.2019.1668894\">limited<\/a>&nbsp;to lay out the full scope of the issue and what may or&nbsp;<a href=\"https:\/\/journals.sagepub.com\/doi\/full\/10.1177\/14614448221090201\">may not<\/a>&nbsp;<a href=\"https:\/\/medium.com\/datasociety-points\/you-think-you-want-media-literacy-do-you-7cad6af18ec2\" target=\"_blank\" rel=\"noreferrer noopener\">work<\/a>&nbsp;to address it. Other interventions such as&nbsp;<a href=\"https:\/\/news.mit.edu\/2020\/warning-labels-fake-news-trustworthy-0303\">content<\/a>&nbsp;<a href=\"https:\/\/mediaengagement.org\/research\/story-labels-and-trust\/\">labels<\/a>,&nbsp;<a href=\"https:\/\/www.science.org\/doi\/10.1126\/sciadv.abl3844\">classifications<\/a>,&nbsp;<a href=\"https:\/\/link.springer.com\/article\/10.1007\/s11109-019-09533-0\">warnings<\/a>&nbsp;or \u201c<a href=\"https:\/\/www.cambridge.org\/core\/journals\/american-political-science-review\/article\/abs\/educative-interventions-to-combat-misinformation-evidence-from-a-field-experiment-in-india\/A522EB5164406DE320647014946D31B3\">pre-bunking<\/a>\u201d have proven to be&nbsp;<a href=\"https:\/\/edition.cnn.com\/2023\/04\/20\/tech\/meta-covid-misinformation-oversight-board\/index.html\">counter productive<\/a>&nbsp;or inconsistently effective in practice. Even when&nbsp;<a href=\"https:\/\/partnershiponai.org\/it-matters-how-platforms-label-manipulated-media-here-are-12-principles-designers-should-follow\/\">strategies<\/a>seem to work, it remains unclear whether the effects&nbsp;<a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/33017160\/\">last<\/a>.<\/li>\n\n\n\n<li>More broadly, drawbacks to existing research on disinformation include: concentration around a few wealthy democracies,&nbsp;<a href=\"https:\/\/osf.io\/9yrp4\/\">disproportionate<\/a>&nbsp;attention to the Global North and English-speaking communities, inconsistent concepts for and&nbsp;<a href=\"https:\/\/mediawell.ssrc.org\/research-reviews\/defining-disinformation\/\">definitions<\/a>&nbsp;of problematic information, limited understanding of the&nbsp;<a href=\"https:\/\/www.cambridge.org\/core\/books\/retooling-politics\/146A770F6DF312C1AF1B34A8C7AF35CF\">effects<\/a>&nbsp;of media and&nbsp;<a href=\"https:\/\/mediawell.ssrc.org\/articles\/on-digital-disinformation-and-democratic-myths\/\">media technologies<\/a>, an overemphasis on social media platforms like&nbsp;<a href=\"https:\/\/ojs.aaai.org\/index.php\/ICWSM\/article\/view\/14517\">Twitter<\/a>&nbsp;and an underemphasis of the historical and&nbsp;<a href=\"https:\/\/www.niemanlab.org\/2023\/06\/when-it-comes-to-misinformation-partisanship-overpowers-fact-checking-over-and-over-again\/\">political<\/a>&nbsp;<a href=\"https:\/\/misinforeview.hks.harvard.edu\/article\/critical-disinformation-studies-history-power-and-politics\/\">contexts<\/a>&nbsp;of disinformation.&nbsp;<\/li>\n\n\n\n<li>Some experts openly caution against the&nbsp;<a href=\"https:\/\/harpers.org\/archive\/2021\/09\/bad-news-selling-the-story-of-disinformation\/\">outsized influence<\/a>&nbsp;of the current research on policy and political responses to disinformation, which they say has contributed to problematic actions or policies that threaten&nbsp;<a href=\"https:\/\/journals.sagepub.com\/doi\/10.1177\/2056305120948190\">press freedom<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.economist.com\/international\/2021\/02\/13\/censorious-governments-are-abusing-fake-news-laws\">human rights<\/a>.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Future work could provide more systematic global research needed to design more effective measures against mis- and disinformation. This includes studying the scale and impact of mis- and disinformation in countries outside of the U.S. and in comparative contexts. For instance, it is unclear whether strategies that are proven to be effective in countries with higher education and literacy levels would also apply elsewhere. There is also a need for understanding the agents and infrastructures involved in the&nbsp;<a href=\"https:\/\/knightfoundation.org\/articles\/study-online-disinformation-fuels-mistrust-of-science\/\">spread<\/a>&nbsp;of mis- and disinformation online and offline, particularly when it comes to&nbsp;<a href=\"https:\/\/academic.oup.com\/joc\/advance-article\/doi\/10.1093\/joc\/jqac051\/7060057\">video<\/a>&nbsp;and image-based content as well as&nbsp;<a href=\"https:\/\/www.tandfonline.com\/doi\/abs\/10.1080\/10584609.2023.2193563?journalCode=upcp20\">messaging applications<\/a>. has-aktiv-grotesk-condensed-font-family has-delta-font-size\">State of Legislation<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The global landscape around what legislators consider harmful content or disinformation is diverse, often complicated and reaches back centuries in some countries. Legislators\u2019 treatment of disinformation has ranged from a desire to protect election integrity against domestic or foreign interference to obvious schemes to&nbsp;stifle&nbsp;political dissent. There has been a considerably greater effort to regulate what can be said and by whom in recent years, particularly in the wake of the COVID-19&nbsp;pandemic. Efforts to respond to disinformation are critical, but policy must not set the stage for the dismantling of an independent press or an open internet. Specific areas of concern include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Both highly democratic countries and authoritarian regimes increasingly regulate online discourse. The latter regularly target critical voices under the banner of tackling disinformation, often by abusing a state of crisis or emergency to justify state censorship, and often without time limits. Measures may either have&nbsp;vague wordingand broad scope, thus intentionally or unintentionally creating room for misuse, or may be too narrow in scope to effectively combat disinformation.\u2028<\/li>\n\n\n\n<li>Sanctions within the legislative framework include financial penalties, jail time, bandwidth restrictions, advertising bans and blocking, depending on whether they address individuals or companies. Several challenges remain, including how to enforce regulations across borders (if the source for disinformation comes from a wholly different legal environment) as well as how to prevent \u201cchilling effects\u201d and self-censorship in newsrooms for fear of punishment.\u2028<\/li>\n\n\n\n<li>Even non-authoritarian governments have vastly&nbsp;different approaches&nbsp;toward what they deem illegal content. In the EU, companies hosting others\u2019 data are liable if, upon actual knowledge of it, they fail to act and remove illegal content. This fundamentally differs from existing immunities in countries like the U.S., likely due to its historical commitment to free speech. This legal patchwork creates further challenges for transnational corporations.\u2028<\/li>\n\n\n\n<li>Despite the wealth of evidence that disinformation&nbsp;flows&nbsp;both top-down and bottom-up, policy attempting to address&nbsp;top-down&nbsp;disinformation (e.g., from domestic politicians or&nbsp;celebrities&nbsp;and&nbsp;foreign governments) has largely been absent while there has been an overwhelming focus on bottom-up mis- and disinformation (e.g., within platforms and their users).<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">As disinformation receives growing attention by elected leaders and academics, there should be a similar focus on&nbsp;legislative&nbsp;attempts to face a rapidly changing information environment. As much as possible, efforts need to be rooted in a clear understanding of the actors and their differing roles as well as in protection for an independent press, freedom of expression and fundamental human rights. Both the inadequacies and best practices of existing global legislation must be discussed openly. Additionally, in rule-of-law countries, there is a need for more political and public awareness that legislation may be weaponized by authoritarian regimes, worsening already restrictive situations for human rights groups, political opposition and independent news media.ther strategies that are proven to be effective in countries with higher education and literacy levels would also apply elsewhere.
