{"id":8491,"date":"2024-01-18T22:00:00","date_gmt":"2024-01-19T03:00:00","guid":{"rendered":"https:\/\/cntiwpedev.wpenginepowered.com\/?p=8491"},"modified":"2025-10-03T13:28:35","modified_gmt":"2025-10-03T17:28:35","slug":"most-fake-news-legislation-risks-doing-more-harm-than-good-amid-a-record-number-of-elections-in-2024","status":"publish","type":"post","link":"https:\/\/cnti.org\/reports\/most-fake-news-legislation-risks-doing-more-harm-than-good-amid-a-record-number-of-elections-in-2024\/","title":{"rendered":"Most &#8220;Fake News&#8221; Legislation Risks Doing More Harm Than Good Amid a Record Number of Elections in 2024"},"content":{"rendered":"\n<h2 class=\"wp-block-heading has-aktiv-grotesk-condensed-font-family has-delta-font-size\" id=\"Introduction\" style=\"text-transform:capitalize\">Introduction<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">As the world launches into 2024, we face a year with a&nbsp;record-breaking&nbsp;number&nbsp;of&nbsp;<a href=\"https:\/\/www.americanprogress.org\/article\/protecting-democracy-online-in-2024-and-beyond\/\" target=\"_blank\" rel=\"noreferrer noopener\">countries<\/a>&nbsp;(50) holding national elections including the United States, India and Mexico. With these elections come heightened concerns about the spread of disinformation and the challenge of providing voters with fact-based news.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Discussions about how to guard against disinformation and encourage the delivery of fact-based news are critical. In working toward the best actionable outcomes, these discussions need to consider both the potential and realized impact of recent legislative policies related to this topic. This study focuses specifically on policies laid out as guarding against \u201cfake news.\u201d&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Legislation targeting \u201cfake news\u201d \u2014 a&nbsp;<a href=\"https:\/\/apo.org.au\/node\/134521\" target=\"_blank\" rel=\"noreferrer noopener\">contested term<\/a>&nbsp;used to reference both news and news providers that governments (or others) reject as well as disinformation campaigns \u2014 has increased significantly over the last few years, particularly in the wake of&nbsp;<a href=\"https:\/\/ipi.media\/covid19-media-freedom-monitoring\/\" target=\"_blank\" rel=\"noreferrer noopener\">COVID-19<\/a>. This study finds that even when technically aimed at&nbsp;<a href=\"https:\/\/cnti.org\/article\/addressing-disinformation\/\">curbing disinformation<\/a>, the majority of \u201cfake news\u201d laws, either passed or actively considered from 2020 to 2023, lessen the protection of an independent press and risk the public\u2019s open access to a plurality of fact-based news.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Indeed, governments can \u2014 and&nbsp;<a href=\"https:\/\/www.cima.ned.org\/publication\/chilling-legislation\/\" target=\"_blank\" rel=\"noreferrer noopener\">have<\/a>&nbsp;\u2014&nbsp;<a href=\"https:\/\/www.nytimes.com\/2022\/10\/14\/world\/europe\/turkey-jail-fake-news.html\" target=\"_blank\" rel=\"noreferrer noopener\">used<\/a>&nbsp;this type of legislation to label independent journalism as \u201cfake news\u201d or disinformation. Oversight power in the hands of the government \u2014 whether explicitly or by default \u2014 introduces greater risk of governmental press control.<\/p>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:16px\" aria-hidden=\"true\"><\/div>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" to guard against false news and information in a way that safeguards an independent press and public access to a plurality of fact-based news should consider:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Is legislative policy or other non-governmental methods the best approach to address disinformation?<\/li>\n<\/ol>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:16px\" aria-hidden=\"true\"><\/div>\n<\/div>\n<\/li>\n<\/ul><div class=\"swiper-pagination\"><\/div><\/div>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:32px\" aria-hidden=\"true\"><\/div>\n\n\n\n<section id=\"introduction\" class=\"wp-block-group is-layout-flow wp-block-group-is-layout-flow\">\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:var(--wp--preset--spacing--40)\" aria-hidden=\"true\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">There are several pieces of legislation, such as the United Kingdom\u2019s&nbsp;<a href=\"https:\/\/bills.parliament.uk\/bills\/3137\" target=\"_blank\" rel=\"noreferrer noopener\">Online Safety Act<\/a>, that are important to consider in broader policy discussions about online safety and algorithmic regulation (and are discussed in other&nbsp;<a href=\"https:\/\/cnti.org\/article\/algorithms-quality-news\/\">CNTI<\/a>&nbsp;<a href=\"https:\/\/cnti.org\/article\/enhancing-algorithmic-transparency\/\">reports)<\/a>&nbsp;but they go beyond the scope of this study. This analysis examines the language within 32 \u201cfake news\u201d policies proposed or enacted from 2020 to 2023 in 31 countries, 11 of which have elections scheduled in 2024.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Overall, the study reveals that the language in the 32 pieces of legislation does little to protect fact-based news and in many cases creates significant opportunity for government control of the press.&nbsp;The lack of safeguards in this legislation risks curbing press and journalistic freedoms heading into a major election year. Among the key findings:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>\u201cFake\u201d or \u201cfalse\u201d news is explicitly defined in less than a quarter (7\/32) of this legislation.&nbsp;<\/strong>Omission of these definitions leaves them open to interpretation by whomever has oversight authority which, in these cases, is often the government itself.&nbsp;<\/li>\n\n\n\n<li><strong>In what is very much a double-edged sword, two pieces of legislation examined here explicitly define journalism or what may be considered \u201creal\u201d news,<\/strong>&nbsp;one defines journalists and four define news organizations. While definitions can help protect press freedom, they can also be used as legal grounds to protect media that props up the government and ban media that does not \u2014 especially if the court\u2019s application is also dictated by the government.&nbsp;<\/li>\n\n\n\n<li><strong>14 of the 32 policies clearly designate the government with the authority to decide what is or is not \u201cfake news.\u201d&nbsp;<\/strong>In some cases it is the central government itself and in others it is an entity within the government whose independence from the central government is often unclear. The remaining 18 policies provide either vague or no language about who has that control, ceding it to the government by default. Putting this power in the hands of the government \u2014 whether explicitly or by default \u2014 introduces greater risk of governmental press and message control.<\/li>\n\n\n\n<li><strong>Although press control issues are more prevalent in the countries with autocratic rather than democratic regimes, definitional issues and a lack of clarity are found in legislation from both regime types.&nbsp;<\/strong>Of the 31 countries studied, 19 are autocratic and 11 are democracies as identified by the research organization V-Dem.<sup>1<\/sup><\/li>\n\n\n\n<li><strong>Criminal penalties for the publication of \u201cfake news\u201d vary dramatically, from fines to suspension of publications to imprisonment.&nbsp;<\/strong>Among the 27 policies with clearly noted penalties, three-quarters (20 policies) include imprisonment, ranging from less than one month in Lesotho to up to 20 years in Zimbabwe.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These findings warrant concern. Vague or missing definitions can create, intentionally or not, opportunities for governments to censor opposing voices and restrict press freedom and freedom of expression. Any legislation, even if developed while under leadership that values an independent press, must account for the possibility of future regime change or legal interpretation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Putting hard lines around false information is certainly&nbsp;<a href=\"https:\/\/cnti.org\/article\/addressing-disinformation\/#:~:text=A%20core%20challenge,content%20constitute%20it.\">not easy<\/a>. The challenge is exacerbated when trying to discern intentional versus unintentional efforts to mislead. Legislation can be an important part of creating a digital news environment that safeguards both an independent press and the public\u2019s access to fact-based news, but those aiming to develop policy should be aware of these challenges. CNTI offers five key questions that anyone seeking to construct policy to guard against false information in a way that safeguards an independent press and public access to a plurality of fact-based news should consider. Detailed in the \u201cImportant Policy Considerations\u201d section of this report, they include:&nbsp;<strong>1)<\/strong>&nbsp;whether policy or other non-governmental methods are the best approach for the current situation;&nbsp;<strong>2)<\/strong>&nbsp;if specific independent oversight is laid out;&nbsp;<strong>3)<\/strong>&nbsp;whether there are clear adjudication processes;&nbsp;<strong>4)<\/strong>&nbsp;who the subject \u2014 or target \u2014 of the policy is; and&nbsp;<strong>5)<\/strong>&nbsp;what future or global implications might emerge?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This report is one of many CNTI efforts to help address the challenges of today\u2019s digital news environment in ways that safeguard an independent, competitive news media and the public\u2019s access to a plurality of fact-based news. It is also a part of CNTI\u2019s work in the specific area of defining journalism in our digital, global society. Any legislation related to journalism and news needs to thoroughly address the range of implications that can ensue.<\/p>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:32px\" aria-hidden=\"true\"><\/div>\n<\/section>\n\n\n\n<section id=\"approaches-to-fake-news-policy\" class=\"wp-block-group is-layout-flow wp-block-group-is-layout-flow\">\n<h2 class=\"wp-block-heading has-aktiv-grotesk-condensed-font-family has-delta-font-size\" id=\"ApproachedToFakeNewsPolicy\" style=\"text-transform:capitalize\">Approaches to &#8220;Fake News&#8221; Policy<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A substantial portion of the legislation we examine was developed in response to the COVID-19 pandemic, often targeting the spread of false information about the pandemic as well as information that contradicts government and public health officials. About two-fifths of the policies examined here (13\/32) focus specifically on false information about COVID-19 and disputing government public health officials. For example:<\/p>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:16px\" aria-hidden=\"true\"><\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:16px\" aria-hidden=\"true\"><\/div>\n\n\n\n<div style=\"min-height: 300px;\"><script type=\"text\/javascript\" defer src=\"https:\/\/datawrapper.dwcdn.net\/ckRNw\/embed.js?v=2\" charset=\"utf-8\"><\/script><noscript><img decoding=\"async\" src=\"https:\/\/datawrapper.dwcdn.net\/ckRNw\/full.png\" alt=\"\"\/><\/noscript><\/div>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:16px\" aria-hidden=\"true\"><\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:16px\" aria-hidden=\"true\"><\/div>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Botswana\u2019s<\/strong>&nbsp;Emergency Powers (COVID-19)&nbsp;<a href=\"https:\/\/faolex.fao.org\/docs\/pdf\/bot195071.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Regulations<\/a>&nbsp;and&nbsp;<strong>South Africa\u2019s<\/strong>&nbsp;amendment to its&nbsp;<a href=\"https:\/\/www.covidlawlab.org\/wp-content\/uploads\/2021\/02\/South-Africa_2020.04.16_Consolidation-of-Regulations-Issued-in-Terms-of-Section-272-of-the-Disaster-Management-Act-2002_EN.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Disaster Management Act<\/a>&nbsp;use the exact same wording, penalizing \u201cany statement, through any medium, including social media, with the intention to deceive any other person about COVID-19; COVID-19 infection status of any person; or any measure taken by the Government to address COVID-19.\u201d<\/li>\n\n\n\n<li><strong>The Philippines\u2019&nbsp;<\/strong><a href=\"https:\/\/legacy.senate.gov.ph\/Bayanihan-to-Heal-as-One-Act-RA-11469.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Bayanihan To Heal As One Act<\/a>&nbsp;penalizes \u201cindividuals or groups creating, perpetuating, or spreading false information regarding the COVID-19 crisis on social media and other platforms.\u201d<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">While a narrow scope might be less susceptible to abuse, these policies nonetheless risk chilling effects on free expression or political criticism. Indeed, narrow \u201chealth\u201d proscriptions have been used in&nbsp;<a href=\"https:\/\/link.springer.com\/chapter\/10.1007\/978-3-030-95100-9_15\" target=\"_blank\" rel=\"noreferrer noopener\">Zimbabwe<\/a>, for example, to persecute journalists questioning COVID-19 policies and exposing corruption in COVID-linked procurement practices. These topic-specific policies also suggest the potential for passing similar legislation in other topic areas deemed risky by the government.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Other recent legislation, meanwhile, include much broader \u2014 and more easily exploited \u2014 phrases about information that criticizes or harms the country\u2019s military or economy, or sows discord:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Greece\u2019s<\/strong>&nbsp;<a href=\"https:\/\/www.hellenicparliament.gr\/UserFiles\/bcc26661-143b-4f2d-8916-0e0e66ba4c50\/11779190.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">legislation<\/a>&nbsp;on false information includes \u201canyone who publicly or via the Internet disseminates or disseminates in any way false news that is capable of causing concern or fear among citizens or of shaking public confidence in the national economy, the country\u2019s defense capability or public health.\u201d&nbsp;<\/li>\n\n\n\n<li><strong>Hungary\u2019s<\/strong>&nbsp;<a href=\"https:\/\/perma.cc\/9LMR-YS3L\" target=\"_blank\" rel=\"noreferrer noopener\">legislation<\/a>&nbsp;denotes anyone who \u201cstates or disseminates any untrue fact or any misrepresented true fact with regard to the public danger that is capable of causing disturbance or unrest in a larger group of persons at the site of public danger\u201d is guilty of a crime.<\/li>\n\n\n\n<li><strong>Myanmar\u2019s<\/strong>&nbsp;<a href=\"https:\/\/www.hrw.org\/sites\/default\/files\/media_2022\/02\/220127%20Cyber-Security-Bill-EN.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">draft legislation<\/a>&nbsp;defines the creation of misinformation and disinformation as \u201ccausing public panic, loss of trust, or social division on cyberspace.\u201d<\/li>\n<\/ul>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:32px\" aria-hidden=\"true\"><\/div>\n<\/section>\n\n\n\n<section id=\"defining-fake-news\" class=\"wp-block-group is-layout-flow wp-block-group-is-layout-flow\">\n<h2 class=\"wp-block-heading has-aktiv-grotesk-condensed-font-family has-delta-font-size\" id=\"DefiningFakeNews\" style=\"text-transform:capitalize\">Defining \u201cFake News\u201d<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">While many countries\u2019 legislation are similar in how they define the type of information that qualifies as false or malicious, the level of specificity varies dramatically across policies, with only occasional shared phrasing (see Table 1).&nbsp;A lack of clarity and use of vague language, when definitional language exists at all, carries risks for journalists and the public.<\/p>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:16px\" aria-hidden=\"true\"><\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:16px\" aria-hidden=\"true\"><\/div>\n\n\n\n<div style=\"min-height: 300px;\"><script type=\"text\/javascript\" defer src=\"https:\/\/datawrapper.dwcdn.net\/fwSdV\/embed.js?v=1\" charset=\"utf-8\"><\/script><noscript><img decoding=\"async\" src=\"https:\/\/datawrapper.dwcdn.net\/fwSdV\/full.png\" alt=\"\" \/><\/noscript><\/div>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:16px\" aria-hidden=\"true\"><\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:16px\" aria-hidden=\"true\"><\/div>\n\n\n\n<p class=\"has-word-break wp-block-paragraph\"><strong>\u201cFake\u201d or \u201cfalse\u201d news<\/strong>&nbsp;(sometimes referred to as disinformation, misinformation or other terminology in legislation)&nbsp;<strong>is explicitly defined in less than a quarter of this legislation<\/strong>&nbsp;(7\/32).&nbsp;As is the case in disinformation studies more broadly, the question of intent often complicates definitions of \u201cfake news,\u201d with four of the seven seeking to separate&nbsp;<em>accidental&nbsp;<\/em>or&nbsp;<em>unintentional<\/em>&nbsp;from&nbsp;<em>intentional<\/em>&nbsp;spreading of false news (see Table 1).<sup>2<\/sup>&nbsp;In some contexts, such as&nbsp;<a href=\"http:\/\/lawsofnigeria.placng.org\/laws\/C38.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Nigeria<\/a>, legislation explicitly states that it is illegal to produce \u201c<em>knowingly<\/em>&nbsp;false\u201d information, though how this definition is adjudicated is unclear.<\/p>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:16px\" aria-hidden=\"true\"><\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:16px\" aria-hidden=\"true\"><\/div>\n\n\n\n<div style=\"min-height: 300px;\"><script type=\"text\/javascript\" defer src=\"https:\/\/datawrapper.dwcdn.net\/ky3e6\/embed.js?v=1\" charset=\"utf-8\"><\/script><noscript><img decoding=\"async\" src=\"https:\/\/datawrapper.dwcdn.net\/ky3e6\/full.png\" alt=\"\" \/><\/noscript><\/div>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:16px\" aria-hidden=\"true\"><\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:16px\" aria-hidden=\"true\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">A natural follow-up question to how false news is defined is if and how journalism \u2014 or what might be considered \u201creal\u201d news \u2014 is defined.&nbsp;<strong>Less than a quarter of these policies define any terms related to journalism<\/strong>. Four of the 32 policies explicitly define&nbsp;<strong>news organizations<\/strong>, while&nbsp;<strong>journalism<\/strong>&nbsp;(as in&nbsp;<em>news<\/em>&nbsp;<em>content<\/em>, not \u201cfake news\u201d) is defined in two of the 32 policies and&nbsp;<strong>journalists<\/strong>&nbsp;in only one.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Even when explicit definitions of journalism are present, they are often vague and thereby open to a wide array of interpretations. For example, in Togo\u2019s 2020&nbsp;<a href=\"https:\/\/www.droit-afrique.com\/uploads\/Togo-Code-2020-presse.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Press and Communication Code<\/a>, journalism is broadly defined as \u201coriginal content\u201d about current events of \u201cgeneral interest.\u201d It is unclear in this legislation what qualifies as \u201coriginal\u201d or what counts as \u201cgeneral interest.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">References to or definitions of \u201cjournalism\u201d or \u201cjournalists\u201d within policy are just as \u2014 if not more \u2014 critical to fully consider than those of \u201cfake news.\u201d While they may be intended to protect independent, pluralistic journalism, these definitions can also be used to sanctify government control of the press.<\/p>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:32px\" aria-hidden=\"true\"><\/div>\n<\/section>\n\n\n\n<section id=\"authority-to-decide\" class=\"wp-block-group is-layout-flow wp-block-group-is-layout-flow\">\n<h2 class=\"wp-block-heading has-aktiv-grotesk-condensed-font-family has-delta-font-size\" id=\"AuthorityToDecideWhatsFake\" style=\"text-transform:capitalize\">Authority to Decide What&#8217;s \u201cFake\u201d<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Another element to consider is the authority responsible for, and the process of, determining what or who constitutes \u201cfake news.\u201d This authority is clearly designated in less than half of the legislation (14\/32), often making legislation susceptible to abuses aimed at&nbsp;<a href=\"https:\/\/www.mfwa.org\/country-highlights\/sierra-leones-new-cybercrime-law-begins-to-bite\/\" target=\"_blank\" rel=\"noreferrer noopener\">curbing<\/a>&nbsp;<a href=\"https:\/\/cpj.org\/2020\/12\/uzbek-parliament-moves-to-criminalize-dissemination-of-false-information\/\" target=\"_blank\" rel=\"noreferrer noopener\">press<\/a>&nbsp;<a href=\"https:\/\/www.article19.org\/resources\/ethiopia-hate-speech-and-disinformation-law-must-not-be-used-to-supress-the-criticism-of-the-government\/\" target=\"_blank\" rel=\"noreferrer noopener\">freedom<\/a>&nbsp;(see Table 1).<\/p>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:16px\" aria-hidden=\"true\"><\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:16px\" aria-hidden=\"true\"><\/div>\n\n\n\n<div style=\"min-height: 300px;\"><script type=\"text\/javascript\" defer src=\"https:\/\/datawrapper.dwcdn.net\/B17UJ\/embed.js?v=1\" charset=\"utf-8\"><\/script><noscript><img decoding=\"async\" src=\"https:\/\/datawrapper.dwcdn.net\/B17UJ\/full.png\" alt=\"\" \/><\/noscript><\/div>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:16px\" aria-hidden=\"true\"><\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:16px\" aria-hidden=\"true\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Among the remaining 18 policies with unclear or no noted oversight authority, 11 of them include regulations for \u201cfake news\u201d or disinformation that are wrapped into broader legislation related to COVID-19. The entity most often noted as having any kind of authority within these broader COVID-19 policies is the country\u2019s health minister, but it is unclear exactly what authority that entails when it comes to adjudicating \u201cfake news\u201d specifically.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Among the 14 policies with clearly noted oversight authorities, the arbiter of such decisions is often designated as the head or body of a government commission, ranging from ministers of communications, information or technology to electronic transactions control boards and communications authorities (see Table 1). Others, in practice, have unclear or limited independence from the state. For instance, Togo\u2019s Haute Autorit\u00e9 de l\u2019Audiovisuel et de la Communication (HAAC) has the authority to sanction media actors and grant press accreditation. While its&nbsp;<a href=\"https:\/\/www.haactogo.tg\/?page_id=46\" target=\"_blank\" rel=\"noreferrer noopener\">structure<\/a>&nbsp;is technically independent from the government, it is not particularly transparent and in the past has been found to&nbsp;<a href=\"https:\/\/2009-2017.state.gov\/j\/drl\/rls\/hrrpt\/2010\/af\/154374.htm\" target=\"_blank\" rel=\"noreferrer noopener\">censor<\/a>&nbsp;news organizations at the state\u2019s request.<\/p>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:32px\" aria-hidden=\"true\"><\/div>\n<\/section>\n\n\n\n<section id=\"penalties\" class=\"wp-block-group is-layout-flow wp-block-group-is-layout-flow\">\n<h2 class=\"wp-block-heading has-aktiv-grotesk-condensed-font-family has-delta-font-size\" id=\"Penalties\" style=\"text-transform:capitalize\">Penalties<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The criminalization of \u201cfake news\u201d has a long history in many countries that have experienced&nbsp;<a href=\"https:\/\/heinonline.org\/HOL\/LandingPage?handle=hein.journals\/ahry2020&amp;div=17&amp;id=&amp;page=\" target=\"_blank\" rel=\"noreferrer noopener\">penal<\/a>&nbsp;<a href=\"https:\/\/heinonline.org\/HOL\/LandingPage?handle=hein.journals\/jintcl9&amp;div=9&amp;id=&amp;page=\" target=\"_blank\" rel=\"noreferrer noopener\">codes<\/a>&nbsp;imposed under&nbsp;<a href=\"https:\/\/www.kas.de\/documents\/285576\/285625\/MLHSA%202021%20Volume%201%20-%20EBOOK.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">colonization<\/a>. Similar types of penalties are embedded in many of these modern policies.<\/p>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:var(--wp--preset--spacing--40)\" aria-hidden=\"true\"><\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:var(--wp--preset--spacing--40)\" aria-hidden=\"true\"><\/div>\n\n\n\n<div style=\"min-height: 300px;\"><script type=\"text\/javascript\" defer src=\"https:\/\/datawrapper.dwcdn.net\/UdPy7\/2\/embed.js?v=1\" charset=\"utf-8\"><\/script><noscript><img decoding=\"async\" src=\"https:\/\/datawrapper.dwcdn.net\/UdPy7\/full.png\" alt=\"\" \/><\/noscript><\/div>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:var(--wp--preset--spacing--40)\" aria-hidden=\"true\"><\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:var(--wp--preset--spacing--40)\" aria-hidden=\"true\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">About four out of five of these policies (27\/32) explicitly note criminal penalties for creating and publishing \u201cfake news\u201d or disinformation \u2014 most commonly fines and\/or imprisonment, though some legislation includes the temporary suspension of news publications (e.g., Togo) or compulsory community service (e.g., Uzbekistan).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Among the 27 policies with clearly noted penalties, three-quarters (20 policies) include imprisonment, ranging from less than one month in Lesotho to up to 20 years in Zimbabwe.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Together, these policies reveal the serious consequences journalists face especially when legislation does not include clear oversight authorities or processes and is then abused by governments. Further, the risk of imprisonment or heavy fines may create broader impacts, discouraging independent journalists through&nbsp; potential consequences such as their work being labeled as \u201cfake news.\u201d<\/p>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:32px\" aria-hidden=\"true\"><\/div>\n<\/section>\n\n\n\n<section id=\"important-policy-considerations\" class=\"wp-block-group is-layout-flow wp-block-group-is-layout-flow\">\n<h2 class=\"wp-block-heading has-aktiv-grotesk-condensed-font-family has-delta-font-size\" id=\"ImportantPolicyConsiderations\" style=\"text-transform:capitalize\">Important Policy Considerations<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">While news and news organizations are not necessarily a central consideration of \u201cfake news\u201d or disinformation policies, the ripple effects of these policies impact independent journalism and press freedom. Codified policies focused on news, disinformation and\/or journalism \u2014 as well any language used to define these and related terms \u2014 carry tremendous power, creating opportunities for governments or other powerful actors to intentionally or unintentionally threaten the independence, diversity and freedom of the press as well as broader elements of free expression.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As Table 1 shows:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A majority of the countries examined in this study (19\/31) have some form of autocratic governance (versus 12 democracies).<\/li>\n\n\n\n<li>Among the 30 countries in this study that also appear in the Reporters Without Borders Press Freedom&nbsp;<a href=\"https:\/\/rsf.org\/en\/index?year=2023\" target=\"_blank\" rel=\"noreferrer noopener\">Index<\/a>, more than half (17\/30) rank in the bottom half of the index.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Together, these findings indicate high risks of undue political influence compounded by vague language and a lack of clear definitions and oversight processes. They also suggest that a majority of these policies may not have been intended to promote democratic values such as an independent press or free expression. Those aiming to construct policy that promotes an informed public and independent press should be aware of these conditions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is critical to take a careful and deliberate approach to codification of what \u201cfake news\u201d (<em>real<\/em>&nbsp;news) is and is not. This is not an easy task, as CNTI discusses in some of our&nbsp;<a href=\"https:\/\/cnti.org\/article\/addressing-disinformation\/\">issue<\/a>&nbsp;<a href=\"https:\/\/cnti.org\/article\/building-news-relevance\/\">primers<\/a>, and has become even more complicated in the digital era. This study reveals five important questions to consider in&nbsp; policy development in this area:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Are legislative policy or other non-governmental methods the best approach to address disinformation?&nbsp;The latter could include processes such as human rights or information risk assessments, content moderation or data sharing on digital platforms, news and media literacy initiatives or other related efforts. Each option, including legislative policy, has potential benefits and harms which are important to think through.<\/strong><\/li>\n\n\n\n<li><strong>Are specific, independent oversight&nbsp;of&nbsp;these definitions included in policy?&nbsp;This can be designated via self-regulatory bodies or through independent government agencies designed to protect against undue political influence.<\/strong><\/li>\n\n\n\n<li><strong>Are there clear adjudication processes for these definitions?&nbsp;Can journalists, news entities or civil society formally challenge definitional decisions by oversight bodies and if so, how?<\/strong><\/li>\n\n\n\n<li><strong>Who is the subject of the policy?&nbsp;Who would be liable? Solely individuals? Publishers? Platforms? Some combination based on the circumstances? While complex, it is important to fully consider who the law would implicate and why.<\/strong><\/li>\n\n\n\n<li><strong>What potential future and global implications might emerge?&nbsp;These decisions have global consequences, as policies in one country inherently impact those in others. And, as&nbsp;<a href=\"https:\/\/www.brookings.edu\/articles\/how-to-deal-with-ai-enabled-disinformation\/\" target=\"_blank\" rel=\"noreferrer noopener\">new<\/a>&nbsp;technologies for disinformation and digital manipulation emerge, new tactics for addressing them may be necessary.&nbsp;<\/strong><\/li>\n<\/ul>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:var(--wp--preset--spacing--50)\" aria-hidden=\"true\"><\/div>\n<\/section>\n\n\n\n<footer id=\"table-1-definitions-or-descriptions-of-fake-news-or-disinformation\" class=\"wp-block-group is-layout-flow wp-block-group-is-layout-flow\">\n<h2 class=\"wp-block-heading has-aktiv-grotesk-condensed-font-family has-delta-font-size\" id=\"Table1DefinitionsOrDescriptionsOfFakeNews\" style=\"text-transform:capitalize\">Table 1. In this case, we have supplemented this data with indicators from the&nbsp;<a href=\"https:\/\/2009-2017.state.gov\/documents\/organization\/160108.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">U.S. Department of State<\/a>, the&nbsp;<a href=\"https:\/\/www.un.int\/vanuatu\/vanuatu\/country-facts\" target=\"_blank\" rel=\"noreferrer noopener\">United Nations<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/freedomhouse.org\/country\/vanuatu\/freedom-world\/2022\" target=\"_blank\" rel=\"noreferrer noopener\">Freedom House<\/a>&nbsp;showing that Vanuatu is a parliamentary democracy and conducts democratic elections.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2.&nbsp;One potential reason we may not see greater similarities in phrasing is that most legislation was translated from the native language to English.<\/p>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:var(--wp--preset--spacing--50)\" aria-hidden=\"true\"><\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-group is-layout-flow wp-block-group-is-layout-flow\">\n<h3 class=\"wp-block-heading has-aktiv-grotesk-condensed-font-family has-echo-font-size\">Methods and Data<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">This study included quantitative and qualitative analyses of 32 \u201cfake news\u201d legislative policies. Two content analysis coders compiled case data and coded for a range of variables including country, short and long titles of legislation, dates of legislation draft and latest update, legislation status, definitions of key terms (\u201cnews\u201d\/\u201cjournalism,\u201d \u201cfake news,\u201d \u201cjournalists,\u201d \u201cnews entities\u201d\/\u201cpublishers\u201d and \u201cplatform\u201d\/\u201cnews intermediary\u201d) and authorities responsible for overseeing each definition. Five test cases were coded by both coders simultaneously to assess intercoder reliability with 99.3% agreement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The coders used a conservative approach to coding definitions. Some pieces of legislation hinted at a concept in an extraneous clause, but if the term was not explicitly defined, it was coded as \u201cnot defined.\u201d Links to all legislation included in this research and the study\u2019s codebook can be viewed&nbsp;<a href=\"https:\/\/docs.google.com\/spreadsheets\/d\/1PwD3t9IhJSEBPsmvcO0RwXjWnv6fGbtv3hxLEVdUsNI\/edit?usp=sharing\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cases representing \u201cfake news\u201d legislative activity from 2020 to 2023 were drawn from the&nbsp;<a href=\"https:\/\/www.cima.ned.org\/publication\/chilling-legislation\/\" target=\"_blank\" rel=\"noreferrer noopener\">Center for International Media Assistance<\/a>&nbsp;(CIMA),&nbsp;<a href=\"https:\/\/lexota.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">LEXOTA<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/lupa.uol.com.br\/lupa-mapa-leis-desinformacao\/\" target=\"_blank\" rel=\"noreferrer noopener\">LupaMundi<\/a>&nbsp;reports and databases. Additional information, including the actual drafts of legislation for analysis, was compiled from government websites and international news articles. Therefore, the analysis was limited to legislation with a full, publicly available draft or bill online. When compiling policies, some public drafts could not be found and were coded as missing cases. Google Translate was used for the 13 policies that were not available in English to keep the source of translation consistent across all pieces of legislation.
