Currently, each platform operates under its own rules and conventions, including what content is shown and prioritized by algorithmic infrastructures and internal company policies. Establishing legal and organizational policy to promote algorithmic transparency is one critical step toward a structure that allows for more accountability for often-opaque digital platform practices related to content selection and moderation processes. Various stakeholders \u2013 including policymakers, researchers, journalists and the public \u2013 also often have different purposes and uses for transparency, which need to be thought through to be sure it serves those needs while protecting against the risks of political or commercial manipulation. These considerations also carry through to who is designated to regulate transparency requirements.<\/p>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:32px\" aria-hidden=\"true\"><\/div>\n<\/section>\n\n\n\n<section class=\"wp-block-group is-layout-flow wp-block-group-is-layout-flow\">\n<h2 class=\"wp-block-heading has-aktiv-grotesk-condensed-font-family has-delta-font-size\" id=\"TheIssue\" style=\"text-transform:capitalize\">The Issue<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The internet is enmeshed in virtually every aspect of modern life. Most often, the public\u2019s online experiences flow through digital platforms, which serve as intermediaries between the content being delivered and the individuals consuming it. That provides convenience but also raises serious concerns. A central one is how much control digital platforms have, or should have, over what people see, especially when it comes to&nbsp;<a href=\"https:\/\/reutersinstitute.politics.ox.ac.uk\/digital-news-report\/2023\" target=\"_blank\" rel=\"noreferrer noopener\">news<\/a>&nbsp;and information, and how transparent digital platforms\u2019 decision-making processes, typically conducted through the use of algorithms, needs to be.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Each digital platform, and its algorithmic infrastructure, operates under its own rules and conventions to determine which content is and is not&nbsp;<em>allowed<\/em>&nbsp;as well as what content is&nbsp;<em>prioritized<\/em>&nbsp;on the platform. Algorithmic choices have far-reaching implications ranging from determining user experiences by selecting one news story over another to facilitating&nbsp;<a href=\"https:\/\/www.niemanlab.org\/2022\/09\/researchers-ask-does-enforcing-civility-stifle-online-debate\/\" target=\"_blank\" rel=\"noreferrer noopener\">hate<\/a>&nbsp;speech,&nbsp;<a href=\"https:\/\/www.niemanlab.org\/2023\/01\/beyond-section-230-three-paths-to-making-the-big-tech-platforms-more-transparent-and-accountable\/\" target=\"_blank\" rel=\"noreferrer noopener\">disinformation<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/www.wired.com\/story\/meta-hate-speech-lawsuit-ethiopia\/\" target=\"_blank\" rel=\"noreferrer noopener\">violence<\/a>.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Policymakers, journalists, social media researchers, civil society organizations, private corporations and members of the public are raising awareness of and questions about what are often-opaque digital platform practices related to content selection and moderation processes. The global news industry in particular \u2013 which relies to a significant degree on digital intermediaries to&nbsp;<a href=\"https:\/\/www.digitalnewsreport.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">reach<\/a>&nbsp;audiences \u2013 has articulated the need for a better understanding of how algorithms rank, boost, restrict and recommend content (including, but not limited to, news) and target consumers. Without a better understanding of how these algorithms are currently built, it is difficult for publishers to work within their constraints to reach audiences or to play any role in determining how algorithms should be built to promote an informed public.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Thus, in addition to ensuring that algorithms are designed to identify fact-based, independent journalism (a topic CNTI addresses in a separate&nbsp;<a href=\"https:\/\/cnti.org\/article\/algorithms-quality-news\/\" target=\"_blank\" rel=\"noreferrer noopener\">issue primer<\/a>),&nbsp;<strong>it is critical to enhance transparency in and accountability for how digital platform algorithms function.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The key challenge is that regulating or mandating transparency is more complex than it appears, with many elements that need to be thought through. What forms of transparency are necessary and most likely to be effective for protecting and promoting access to high-quality, diverse and independent news? What does transparency mean to policymakers, journalists, researchers and the public? How can we enable algorithmic transparency in ways that protect against political and commercial manipulation or abuse and ensure user privacy?<\/strong>&nbsp;<strong>What are its limitations?&nbsp;<\/strong><strong>What systems or entities should be beholden to these levels of transparency? And&nbsp;<\/strong><strong><em>who<\/em><\/strong><strong>&nbsp;should be empowered to set these rules?&nbsp;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Addressing the questions introduced in this primer is a critical first step toward developing approaches to algorithmic&nbsp;<a href=\"https:\/\/datasociety.net\/library\/algorithmic-accountability-a-primer\/\" target=\"_blank\" rel=\"noreferrer noopener\">accountability<\/a>&nbsp;that support an independent, competitive press and an informed society. Policymakers and other stakeholders can benefit from a more nuanced understanding of what transparency can, and cannot, accomplish as well as what new risks could be introduced. Policymakers must be forward-thinking about how and where algorithms may be used in the future, what data could be exposed and who could ultimately gain access to it as a result of increased transparency.<\/p>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:32px\" aria-hidden=\"true\"><\/div>\n<\/section>\n\n\n\n<section class=\"wp-block-group is-layout-flow wp-block-group-is-layout-flow\">\n<h2 class=\"wp-block-heading has-aktiv-grotesk-condensed-font-family has-delta-font-size\" id=\"WhatMakesItComplex\" style=\"text-transform:capitalize\">What Makes It Complex<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>One hurdle in creating valuable algorithmic transparency is being sure that those on the receiving end are armed with the necessary knowledge to assess these processes. <\/strong>A good deal of tension has arisen over how technology companies have responded to requests for&nbsp;<a href=\"https:\/\/www.theverge.com\/2023\/5\/31\/23739084\/twitter-elon-musk-api-policy-chilling-academic-research\" target=\"_blank\" rel=\"noreferrer noopener\">independent<\/a>&nbsp;<a href=\"https:\/\/www.theverge.com\/2023\/2\/21\/23604737\/tiktok-research-api-expansion-public-user-data-transparency\" target=\"_blank\" rel=\"noreferrer noopener\">researcher<\/a>,&nbsp;<a href=\"https:\/\/www.tandfonline.com\/doi\/abs\/10.1080\/21670811.2016.1208053\" target=\"_blank\" rel=\"noreferrer noopener\">journalist<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/services.google.com\/fh\/files\/misc\/hsw-sqrg.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">public<\/a>&nbsp;<a href=\"https:\/\/www.theatlantic.com\/technology\/archive\/2023\/04\/elon-musk-twitter-algorithm-code-public\/673642\/\" target=\"_blank\" rel=\"noreferrer noopener\">access<\/a>&nbsp;to algorithmic processes or their digital&nbsp;<a href=\"https:\/\/www.tandfonline.com\/doi\/abs\/10.1080\/10584609.2018.1477506?journalCode=upcp20\" target=\"_blank\" rel=\"noreferrer noopener\">trace data<\/a>. Transparency policies must take into account each stakeholder\u2019s differing needs, aims and interests and consider what forms of transparency are necessary and appropriate for each. Because the algorithmic processes are complicated and often rely on technological&nbsp;<a href=\"https:\/\/link.springer.com\/article\/10.1007\/s10676-020-09564-w\" target=\"_blank\" rel=\"noreferrer noopener\">jargon<\/a>, there is the risk that even with increased transparency, a lack of understanding of these processes will endure for some stakeholders.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cOpen-source\u201d transparency is not&nbsp;<a href=\"https:\/\/journals.sagepub.com\/doi\/10.1177\/1461444816676645\" target=\"_blank\" rel=\"noreferrer noopener\">enough<\/a>&nbsp;to achieve an understanding of algorithmic processes or&nbsp;<a href=\"https:\/\/deliverypdf.ssrn.com\/delivery.php?ID=899085122013082082097023013087077065042017091058019089127007093028072000100005014071010022102032058043026090065097085081067123060002071073047093071028026026002067108022038031085110088095098095116094066093091089092003009028016026116103071094112121082082&amp;EXT=pdf&amp;INDEX=TRUE\" target=\"_blank\" rel=\"noreferrer noopener\">solve<\/a>&nbsp;the problems of platform accountability. This is true in two different manners. First, some tech leaders have suggested \u201c<a href=\"https:\/\/www.washingtonpost.com\/technology\/2022\/04\/16\/elon-musk-twitter-algorithm\/\" target=\"_blank\" rel=\"noreferrer noopener\">open-source<\/a>\u201d algorithms as an answer to transparency and accountability issues, but algorithmic processes require a level of technical knowledge most stakeholders do not possess in order to understand their complexities. \u201cOpen-source\u201d transparency requires individuals to have the time and capacity to learn the complexities of data governance and content moderation. Context is critical in learning how algorithms work; without a clear understanding of the internal policies dictating algorithmic behaviors or access to their underlying training data, raw information is not interpretable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Determining the parameters of transparency is challenging to do in a single policy.<\/strong> There is broad agreement that&nbsp;<a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=3504930\" target=\"_blank\" rel=\"noreferrer noopener\">transparency<\/a>&nbsp;is a critical component of digital platform governance and content moderation, and that \u201c<a href=\"https:\/\/cyberlaw.stanford.edu\/blog\/2021\/03\/some-humility-about-transparency\" target=\"_blank\" rel=\"noreferrer noopener\">more transparency is better,<\/a>\u201d but, it is not always clear what, and&nbsp;<a href=\"http:\/\/mike.ananny.org\/papers\/anannyCrawford_seeingWithoutKnowing_2016.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">where<\/a>, transparency is being sought. Collaboration between experts is critical to addressing the multifaceted impacts policy on transparency may have. Further, the aim of transparency&nbsp;<a href=\"https:\/\/www.cigionline.org\/articles\/consensus-on-transparency-can-hide-a-deeper-debate\/\" target=\"_blank\" rel=\"noreferrer noopener\">differs<\/a>&nbsp;in market-based versus state-led models, with the former aiming to empower users and the latter aiming to empower regulators. Policymakers, researchers, the news media and civil society must work together to weigh stakeholders\u2019 needs against platforms\u2019 capabilities and consider what regulatory structures will serve to&nbsp;<a href=\"https:\/\/www.brookings.edu\/articles\/transparency-is-the-best-first-step-towards-better-digital-governance\/\" target=\"_blank\" rel=\"noreferrer noopener\">enforce<\/a>&nbsp;this legislation. Finally, as we address in a separate&nbsp;<a href=\"https:\/\/cnti.org\/article\/algorithms-quality-news\/\" target=\"_blank\" rel=\"noreferrer noopener\">issue primer<\/a>, addressing transparency on its own does not address disagreements over how to ensure people see fact-based, independent news content on digital platforms, nor does it address the choices individuals themselves make about what they click on or what kind of information they seek out.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Digital platform regulation needs to protect against political and commercial manipulation as a consequence of algorithmic transparency.<\/strong> As discussed in our issue primer on addressing&nbsp;<a href=\"https:\/\/cnti.org\/article\/addressing-disinformation\/\" target=\"_blank\" rel=\"noreferrer noopener\">disinformation<\/a>, algorithmic transparency (and researcher access to digital trace data) can both help&nbsp;<a href=\"https:\/\/www.noemamag.com\/the-insidious-creep-of-violent-rhetoric\/\" target=\"_blank\" rel=\"noreferrer noopener\">experts<\/a>&nbsp;understand the&nbsp;<a href=\"https:\/\/www.brookings.edu\/articles\/adding-a-d-to-the-abc-disinformation-framework\/\" target=\"_blank\" rel=\"noreferrer noopener\">spread<\/a>&nbsp;of online disinformation and how to counter it and, at the same time, introduce new risks for&nbsp;<a href=\"https:\/\/hbr.org\/2019\/12\/the-ai-transparency-paradox\" target=\"_blank\" rel=\"noreferrer noopener\">manipulation<\/a>&nbsp;and&nbsp;<a href=\"https:\/\/datasociety.net\/wp-content\/uploads\/2019\/11\/Data-Voids-2.0-Final.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">abuse<\/a>. Governments in many parts of the world increasingly&nbsp;<a href=\"https:\/\/techcrunch.com\/2023\/04\/06\/india-cracks-down-on-betting-games\/\" target=\"_blank\" rel=\"noreferrer noopener\">pressure<\/a>&nbsp;platforms to make&nbsp;<a href=\"https:\/\/www.thehindu.com\/news\/national\/twitter-takes-down-post-on-home-minister-globally\/article66711854.ece\" target=\"_blank\" rel=\"noreferrer noopener\">content<\/a>&nbsp;<a href=\"https:\/\/www.theverge.com\/21275532\/trump-twitter-social-media-tweets\" target=\"_blank\" rel=\"noreferrer noopener\">decisions<\/a>&nbsp;that benefit their own political interests. There is also the risk that commercial actors or institutions manipulate algorithms to exploit virality, amplifying large quantities of clickbait and problematic content over fact-based, independent information \u2013 particularly by using new&nbsp;<a href=\"https:\/\/english.elpais.com\/science-tech\/2023-07-17\/ai-fuels-rise-of-content-farms-and-fake-news-outlets.html\" target=\"_blank\" rel=\"noreferrer noopener\">technologies<\/a>&nbsp;like&nbsp;<a href=\"https:\/\/futurism.com\/clickbait-site-generating-images-ai-hilarious\" target=\"_blank\" rel=\"noreferrer noopener\">generative<\/a>&nbsp;AI. Both introduce threats to an independent press and an informed public. Policy must&nbsp;<a href=\"https:\/\/www.brookings.edu\/articles\/how-online-platform-transparency-can-improve-content-moderation-and-algorithmic-performance\/\" target=\"_blank\" rel=\"noreferrer noopener\">safeguard<\/a>&nbsp;against these risks and insulate regulation from political and commercial manipulation, both by ensuring oversight remains independent from governments and by separating regulatory bodies from direct involvement in content moderation decisions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Platforms\u2019 commercial structures are real factors to be considered, both in the way they can negatively drive internal decisions and in the value they bring to our digital environment.<\/strong> Technology companies are&nbsp;<a href=\"https:\/\/www.brookings.edu\/articles\/social-media-companies-and-common-carrier-status-a-primer\/\" target=\"_blank\" rel=\"noreferrer noopener\">private<\/a>&nbsp;business entities that operate in a competitive marketplace with a certain level of value placed on their&nbsp;<a href=\"https:\/\/knightcolumbia.org\/content\/understanding-social-media-recommendation-algorithms\" target=\"_blank\" rel=\"noreferrer noopener\">proprietary<\/a>&nbsp;information and intellectual property. The current concealed nature of algorithmic selection and ranking, however, risks commercial incentives negatively affecting the work of journalists and the content the public receives. Crafting the best transparency policies will require a balance between these two elements, including consideration of potential unintended consequences for innovation or competition, such as deterring startups or smaller players from participation due to costs associated with adhering to regulation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Debates around transparency introduce important opportunities and&nbsp;<a href=\"https:\/\/freedomhouse.org\/report\/freedom-on-the-net\/2019\/the-crisis-of-social-media\/social-media-surveillance\" target=\"_blank\" rel=\"noreferrer noopener\">risks<\/a>&nbsp;for the relationships between governments and platforms. <\/strong>This is particularly important when it comes to&nbsp;<em>who<\/em>&nbsp;<a href=\"https:\/\/www.lawfaremedia.org\/article\/informal-government-coercion-and-problem-jawboning\" target=\"_blank\" rel=\"noreferrer noopener\">oversees<\/a>&nbsp;or regulates algorithmic transparency and what can be asked of platforms when it comes to content moderation. Legislation that does not address these critical questions can threaten an independent press and freedom of expression (for instance, via \u201c<a href=\"https:\/\/www.lawfaremedia.org\/article\/informal-government-coercion-and-problem-jawboning\" target=\"_blank\" rel=\"noreferrer noopener\">jawboning<\/a>\u201d&nbsp;<a href=\"https:\/\/knightcolumbia.org\/blog\/jawboned\" target=\"_blank\" rel=\"noreferrer noopener\">practices<\/a>&nbsp;or other&nbsp;<a href=\"https:\/\/www.thehindu.com\/news\/national\/twitter-takes-down-post-on-home-minister-globally\/article66711854.ece\" target=\"_blank\" rel=\"noreferrer noopener\">legal<\/a>&nbsp;demands of platforms). This is a consistent complexity across many of CNTI\u2019s issue areas and speaks to the importance of considering the balance between legislative and organizational policy (including&nbsp;<em>government-enforced<\/em>&nbsp;organizational policy) in addressing these challenges.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Policy must balance transparency and accountability against user privacy concerns when applicable. <\/strong>Digital platforms\u2019 efforts to improve transparency, when they exist at all, are at times negotiated within the contexts of user privacy concerns and data security concerns. While this does not affect all approaches to algorithmic transparency, questions about what user data digital platforms would be obligated to share and what personal information would be contained in that data will inevitably lead to&nbsp;<a href=\"https:\/\/cyberlaw.stanford.edu\/blog\/2022\/04\/user-privacy-vs-platform-transparency-conflicts-are-real-and-we-need-talk-about-them-0\" target=\"_blank\" rel=\"noreferrer noopener\">trade-offs<\/a>&nbsp;between digital platform transparency and user privacy.<\/p>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:32px\" aria-hidden=\"true\"><\/div>\n<\/section>\n\n\n\n<section class=\"wp-block-group is-layout-flow wp-block-group-is-layout-flow\">\n<h2 class=\"wp-block-heading has-aktiv-grotesk-condensed-font-family has-delta-font-size\" id=\"StateOfResearch\" style=\"text-transform:capitalize\">State of Research<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Over the past decade, questions surrounding digital&nbsp;<a href=\"https:\/\/journals.sagepub.com\/doi\/10.1177\/2056305118787812\" target=\"_blank\" rel=\"noreferrer noopener\">platform<\/a>&nbsp;<a href=\"https:\/\/s3.amazonaws.com\/ssrc-cdn1\/crmuploads\/new_publication_3\/the-rise-of-platforms-challenges-tensions-and-critical-questions-for-platform-governance.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">governance<\/a>&nbsp;have moved to the forefront of political, legal and academic debates. Recently, a breadth of interdisciplinary research has focused on social media platforms and messaging apps central to global journalistic work as well as on the broader range of software companies and&nbsp;<a href=\"https:\/\/www.brookings.edu\/articles\/the-current-and-future-state-of-the-sharing-economy\/\" target=\"_blank\" rel=\"noreferrer noopener\">sharing<\/a>&nbsp;or&nbsp;<a href=\"https:\/\/www.pewresearch.org\/internet\/2021\/12\/08\/the-state-of-gig-work-in-2021\/\" target=\"_blank\" rel=\"noreferrer noopener\">gig<\/a>&nbsp;economy apps central to contemporary online commerce.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Much of this research fits into two categories: governance&nbsp;<a href=\"https:\/\/journals.sagepub.com\/doi\/full\/10.1177\/2056305115578136\" target=\"_blank\" rel=\"noreferrer noopener\"><em>of<\/em><\/a>&nbsp;social media and governance&nbsp;<a href=\"https:\/\/www.sciencedirect.com\/science\/article\/abs\/pii\/S0308596115000592\" target=\"_blank\" rel=\"noreferrer noopener\"><em>by<\/em><\/a>&nbsp;social media. Research focused specifically on digital platform algorithmic transparency represents one small segment of work in this field.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To date, this research has been far more&nbsp;<a href=\"https:\/\/www.tandfonline.com\/doi\/full\/10.1080\/21670811.2016.1208053?casa_token=vLnnE3PNqeEAAAAA%3AvtwKAQ9oQ0W-Hu_jh6td8UiX1ryBWgSK33j20yXO6EuMyRAne8ck5Gl7M8QuxBMr-bzdoKeVI27t\" target=\"_blank\" rel=\"noreferrer noopener\">theoretical<\/a>&nbsp;than empirical, largely due to a lack of data (as we note in greater detail below) and the slow-moving nature of legislative policy, but it still sheds light on the varying&nbsp;<a href=\"https:\/\/www.pewresearch.org\/internet\/2017\/02\/08\/theme-7-the-need-grows-for-algorithmic-literacy-transparency-and-oversight\/\" target=\"_blank\" rel=\"noreferrer noopener\">forms<\/a>&nbsp;of transparency different stakeholders&nbsp;<a href=\"https:\/\/knightfoundation.org\/reports\/the-future-of-tech-policy-american-views\/\" target=\"_blank\" rel=\"noreferrer noopener\">expect<\/a>. For instance,&nbsp;<a href=\"https:\/\/medium.com\/datasociety-points\/algorithms-transparency-problem-is-everyone-s-problem-9a28e7e88cdb\" target=\"_blank\" rel=\"noreferrer noopener\"><em>public<\/em><\/a>&nbsp;transparency via disclosures looks different from, and accomplishes different aims than,&nbsp;<em>research<\/em>&nbsp;transparency via data access.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Research findings have also noted the&nbsp;<a href=\"https:\/\/journals.sagepub.com\/doi\/10.1177\/1461444816676645\" target=\"_blank\" rel=\"noreferrer noopener\">limitations<\/a>&nbsp;of algorithmic transparency alone as a means of establishing digital platform accountability as well as the challenges various&nbsp;<a href=\"https:\/\/techpolicy.unc.edu\/wp-content\/uploads\/2022\/04\/UNC_CTP_Understanding_Enforcement_and_Investment.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">legislative<\/a>&nbsp;<a href=\"https:\/\/cdt.org\/wp-content\/uploads\/2021\/12\/12132021-CDT-Making-Transparency-Meaningful-A-Framework-for-Policymakers-final.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">efforts<\/a>&nbsp;face in addressing algorithmic transparency, ranging from potential free expression violations to individual privacy infringements. These limitations have led some experts to call for forms of digital platform accountability&nbsp;<a href=\"https:\/\/journals.sagepub.com\/doi\/10.1177\/1461444816676645\" target=\"_blank\" rel=\"noreferrer noopener\"><em>beyond<\/em><\/a>&nbsp;algorithmic transparency.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Collectively, this work also reveals how little has changed, both via research and policy, in almost a decade of calls for algorithmic accountability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Looking forward, there is much that we do not yet know about digital platforms\u2019 algorithmic infrastructures. Research in this area is critical to inform current debates about internet governance. Experts have&nbsp;<a href=\"https:\/\/citizensandtech.org\/ethics-of-independent-tech-research\/\" target=\"_blank\" rel=\"noreferrer noopener\">called<\/a>&nbsp;for&nbsp;<a href=\"https:\/\/cdt.org\/wp-content\/uploads\/2023\/01\/2023-01-27-CDT-Defending-Data-Privacy-Protection-Independent-Researchers-and-Access-to-Social-Media-Data-final.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">independent<\/a>&nbsp;<a href=\"https:\/\/www.vox.com\/22622070\/facebook-data-covid-19-vaccine-misinformation-researchers-access-nyu-academics\" target=\"_blank\" rel=\"noreferrer noopener\">researchers<\/a>&nbsp;and civil society to be granted more&nbsp;<a href=\"https:\/\/internetlab.org.br\/en\/projetos\/latin-american-researchers-access-to-platform-data\/\" target=\"_blank\" rel=\"noreferrer noopener\">access<\/a>&nbsp;to the inner workings of digital platform technology companies, the algorithms they develop and the trace data they collect \u2013 particularly as digital platforms steadily move away from more&nbsp;<a href=\"https:\/\/www.nature.com\/articles\/d41586-023-00480-9\" target=\"_blank\" rel=\"noreferrer noopener\">open<\/a>&nbsp;<a href=\"https:\/\/techcrunch.com\/2018\/07\/02\/facebook-rolls-out-more-api-restrictions-and-shutdowns\/\" target=\"_blank\" rel=\"noreferrer noopener\">models<\/a>&nbsp;of free data sharing through their&nbsp;<a href=\"https:\/\/www.theguardian.com\/technology\/2023\/feb\/07\/techscape-elon-musk-twitter-api\" target=\"_blank\" rel=\"noreferrer noopener\">APIs<\/a>. Of course, what access to give to whom is itself part of the debate about transparency. Still, access, when it has the appropriate safeguards,&nbsp;<em>can<\/em>&nbsp;help to better inform policy-making and contribute to democratic processes as a form of checks and balances on government and corporate power.<\/p>\n\n\n\n<div class=\"wp-block-gridible-responsive-spacer\" style=\"height:var(--wp--preset--spacing--50)\" aria-hidden=\"true\"><\/div>\n\n\n\n<div class=\"wp-block-group While some technology companies have taken steps&nbsp;<a href=\"https:\/\/services.google.com\/fh\/files\/misc\/hsw-sqrg.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">internally<\/a>&nbsp;to improve organizational transparency, governments are beginning to consider policy initiatives that require specific forms of platform accountability, with a focus on (1) supporting research access to data, (2) protecting user data privacy and (3) disclosing certain content moderation practices.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Some&nbsp;<a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=4377578\" target=\"_blank\" rel=\"noreferrer noopener\">experts<\/a>&nbsp;have cautioned against the risk that poorly designed transparency laws could become a mechanism for state intervention in and control over platforms\u2019 editorial policies. In contexts like the U.S. with strong constitutional protections of free expression, it is unclear whether the government&nbsp;<em>can<\/em>&nbsp;mandate transparency.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The establishment of international ethical frameworks for platform accountability is complicated by the fact that most institutional structures for oversight, such as review boards or ethics committees,&nbsp;<a href=\"https:\/\/aoir.org\/reports\/ethics3.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">vary<\/a>&nbsp;greatly by country. Nonetheless, policymakers, particularly in&nbsp;<a href=\"https:\/\/www.consilium.europa.eu\/en\/press\/press-releases\/2023\/05\/23\/council-calls-for-transparent-equitable-and-open-access-to-scholarly-publications\/\" target=\"_blank\" rel=\"noreferrer noopener\">Europe<\/a>&nbsp;and the&nbsp;<a href=\"https:\/\/www.lawfaremedia.org\/article\/a-vision-for-regulatory-harmonization-to-spur-international-research\" target=\"_blank\" rel=\"noreferrer noopener\">U.S.<\/a>, have called for international cooperation when it comes to&nbsp;<a href=\"https:\/\/www.washingtonpost.com\/documents\/7defdc1b-ca19-49d9-85f7-4a28503f09d7.pdf?itid=lk_inline_manual_8\" target=\"_blank\" rel=\"noreferrer noopener\">facilitating<\/a>&nbsp;transparency and access to cross-platform research. Experts have also called for multi-stakeholder and (supra-)national&nbsp;<a href=\"https:\/\/www.sciencedirect.com\/science\/article\/pii\/S0267364919303887\" target=\"_blank\" rel=\"noreferrer noopener\">legislative<\/a>&nbsp;efforts to govern digital spaces.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Even if not intentional, policymakers need to consider that a legislative framework in any one country has the potential to influence regulation globally.
